The following Terms and Conditions must be agreed to on booking our services. In these terms and conditions you are hereinafter referred to as the CLIENT, and Emenys Entertainment, is hereinafter called Emenys or Emenys Entertaimnet.
This agreement is made between the Client and the Emenys and will be binding upon both parties once accepted by the Client
1. Booking and Payment
1.1. A booking is only confirmed upon receipt of the Non-Refundable Booking Fee of £50 and agreement of our terms & condtions Emenys Entertainment cannot hold a date or agree to an Event without the Non-Refundable Booking Fee and agreed Entertainment Agreement. This fee secures the Event and covers initial administrative and preparatory work by Emenys Entertainment. The Non-Refundable Booking Fee will be deducted from the Total Fee, leaving the remaining balance to be paid as per these terms.
1.2. The Client agrees to pay the Balance before the event starts via Card (Chip & Pin) direct with the DJ or PayPal using the Payments link found on our website www.Emenys.co.uk. Failure to pay the Balance by this time may result in the cancellation of the booking, with the Non-Refundable Booking Fee forfeited. We do not accept CASH. Clients are welcome to pay weekly before the event uaing Payment link on our website using your booking referance.
2. Requirements
2.1. Emenys Entertainment requires adequate access to the venue before and after the Event to allow for the setup and breakdown of equipment. A minimum of 60 minutes should be allowed for setting up, and 60 minutes for packing up and vacating the premises. The Client should notify Emenys Entertainment of any access restrictions or limitations in advance.
2.2. Emenys Entertainment requires a minimum approximate space of 4 metres wide by 2.5 metres deep for the Disco setup, While Emenys Entertainment will work with any space constraints, the Client must notify Emenys Entertainment of any such constraints in advance. Failure to meet these requirements without prior notice may result in a modified service or cancellation without refund.
2.3. The Client is responsible for providing a safe, suitable, and properly earthed electricity supply. Emenys Entertainment requires two 13 A mains sockets (within 5 metres of the setup area). If at any point Emenys Entertainment deems the electricity supply unsafe, Emenys Entertainment reserves the right to delay, suspend, or terminate the performance until the issue is resolved. If the problem cannot be rectified, Emenys Entertainment may cancel the Event without refund.
2.4. The Client warrants that they have the necessary permissions to use the venue for the Event and that the Event does not violate any law, by-law, or venue restrictions. The Client is responsible for obtaining all necessary licences (e.g., PRS music licence) required for the Event. The Client agrees to indemnify Emenys Entertainment against any fines, penalties, or costs that arise from failure to secure such licences.
2.5. If the Event is held in a marquee or external venue, the Client must ensure that the working area is dry, weather-protected, properly floored, and that a minimum of two 13A voltage-regulated and earthed electricity supplies are close to the setup area. Emenys Entertainment cannot operate from generator supplies unless agreed in advance.
3. Changes to Contracted Playing Time
3.1. Client requests for extended playing time are at Emenys Entertainment discretion and subject to availability. Emenys Entertainment will make reasonable efforts to accommodate such requests. Any extensions are subject to an additional overtime rate per hour after the agreed playing time. £25 per hour before midnight or £45 per hour after midnight
3.2. If the Client requests early termination of the entertainment, no refunds will be provided. Additionally, if the performance is terminated due to safety concerns or non-compliance with these terms, no refund will be issued.
4. Audience Conduct
4.1. The Client is responsible for providing and maintaining adequate supervision over guests at all times. Any damage, loss, or theft caused by the Client, guests, venue staff, or other attendees to Emenys Entertainment equipment, vehicles, or personal belongings is the responsibility of the Client. The Client agrees to pay for any damage within 10 days of receiving notification from Emenys Entertainment of the assessed damage costs

4.2. If at any time before or during the Event, Emenys Entertainment deems their staff or property to be under threat, either verbally or physically, Emenys Entertainment reserves the right to suspend or terminate services immediately without refund. The Client will be informed of the situation as soon as possible. If the issue remains unresolved, Emenys Entertainment may cancel the performance without further notice or liability.
4.3. If minors (under 16 years of age) are present at the Event, the Client or parent/guardian is responsible for their behaviour and safety.
5. Non-Attendance
5.1. Emenys Entertainment will use reasonable efforts to attend the Event. In the unlikely event that Emenys Entertainment cannot attend due to unforeseen circumstances such as illness or accident, Emenys Entertainment will endeavour to provide a suitable substitute DJ of comparable quality and experience at no additional cost to the Client. If a substitute cannot be found, the Client will receive a full refund of all money paid to Emenys Entertainment for that Event, with no further liability attributed to Emenys Entertainment.
5.2. Emenys Entertainment will not be liable for non-attendance or late arrival caused by events beyond its reasonable control, including but not limited to severe weather, road closures, accidents, acts of terrorism, fuel shortages, industrial action, government restrictions, or other force majeure events.
6. Cancellation Policy
6.1. Cancellations made by the Client more than 28 calendar days before the Event will result in the forfeiture of the Non-Refundable Booking Fee, but no further fees will be charged. Cancellations made fewer than 28 calendar days before the Event will require the Client to pay the remaining balance of the Total Fee in full within 10 working days of cancellation, regardless of the reason for cancellation.
7. Photography/Videography/Media
7.1. Emenys Entertainment reserves the right to capture photographs, video, audio, or other media documentation of the Event for its own marketing purposes. The Client expressly consents to such use. If the Client wishes to opt out of any media documentation, they must do so in writing or via email before the Event.
7.2. By attending the Event, all persons grant Emenys Entertainment the right to use any photographs or recordings for marketing, promotional, or advertising purposes. The Client agrees to indemnify Emenys Entertainment against any claims for libel or invasion of privacy arising from such use, provided the Client has not opted out prior to the Event.
7.3. Emenys Entertainment complies with all relevant data protection laws, including the UK General Data Protection Regulation (GDPR). No media featuring personal data will be shared with third parties without consent.
8. Limitation of Liability
8.1. Emenys Entertainment liability for any claim, loss, or damage arising from or in connection with this contract shall not exceed the amount paid by the Client under this contract. Emenys Entertainment shall not be liable for any indirect or consequential losses.
9. Insurance
9.1. Emenys Entertainment carries public liability insurance with coverage of up to £10 million. However, this insurance does not cover any damage caused by guests, venue staff, or third-party negligence. The Client agrees to be responsible for any claims arising from such third-party actions.
10. Use of Equipment
10.1 Only Emenys and their assistant(s) may operate equipment. Under no circumstances may unauthorised personnel tamper with, move or attempt to use equipment owned by Emenys. The Emenys cannot accept responsibility for damage to property, or injury to persons caused directly or indirectly by third party interference.
10.2 Emenys Entertainment shall provide all sound equipment, microphones and lighting necessary for the Performance. Emenys agrees to provide all personnel required to assist the set up of equipment, conduct the Performance and dismantle the equipment after the Performance.
In the unlikely event of a complete equipment failure (excluding circumstances beyond Emenys Entertainment control e.g. a power outage) that cannot be rectified on the spot Emenys will attempt to get replacement equipment to the Venue as soon as possible. A pro-rata refund will be given for the time not performing.
Special requirements in regard to equipment (e.g. radio microphones, smoke machine) must be notified at least fourteen days prior to the Performance Date and will be subject to availability (additional charges may apply). Smoke machines will only be used with the prior written consent of the Venue management.
10.3 Emenys Entertainment will not be held responsible for sound levels at Venues which have Sound Limiters fitted. Emenys Entertainment will inform the Client that there is a Sound Limiter present before commencement of Performance. Similarly, should the Client be aware that the Venue has a Sound Limiter, Emenys Entertainment must be told at least fourteen days prior to Performance Date.
10.4 Emenys Entertainment will ensure that all electrical equipment used will be compliant with the relevant Health & Safety legislation regarding the equipment and personnel. A PAT (Portable Appliance Test) certificate will be available for inspection. Emenys Entertainment will not responsible for any damage caused by the guests to the building where the services are provided, nor the building's contents. Should the Venue need to be evacuated for any reason the responsibility for ensuring that this is done will not rest with Emenys Entertainment.
11. Late Payments
11.1 Failure by client to pay any outstanding fees as per the contract terms will result in interest being charged on overdue amounts at a minimum rate of 8% interest above the bank base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the The Late Payment of Commercial Debts Regulations 2002. Payments overdue by more than 60 days will be passed to a debt collection agency or court with the client fully responsible for payment of any additional fees incurred.
